It is our policy to respond to clear notices of alleged copyright infringement in compliance with the Digital Millennium Copyright Act (DMCA). This page outlines the process for submitting a DMCA takedown notice to Top Trends Hub and what you can expect if you are a content creator whose work has been allegedly infringed.

Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on Top Trends Hub, you may submit a DMCA takedown notice. To do so, please provide the following information in writing:

  1. Identification of the copyrighted work: Provide a description of the copyrighted work that you believe has been infringed, including details that allow us to identify the specific work.
  2. Identification of the infringing material: Provide a description of where the material that you claim is infringing is located on the website (e.g., a specific URL).
  3. Your contact information: Provide your full name, mailing address, telephone number, and email address.
  4. A statement of good faith: Include a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner of the copyrighted work or are authorized to act on behalf of the owner.
  6. Your signature: Provide a physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner.

What Happens Next

After receiving a valid DMCA takedown notice, Top Trends Hub will:

  1. Review the Notice: We will review the submitted notice to ensure that it meets the DMCA requirements.
  2. Remove or Disable Access: If the notice is valid, we will remove or disable access to the allegedly infringing material.
  3. Notify the User: We will notify the user who uploaded the material that a takedown notice has been filed against their content.
  4. Counter-Notice: If the user believes that their content was removed by mistake or misidentification, they have the right to submit a counter-notice. This counter-notice must include the following:
    • Identification of the material that has been removed or to which access has been disabled.
    • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
    • The user’s name, address, telephone number, and a statement that they consent to the jurisdiction of the federal court in their district, or if outside the United States, the jurisdiction of any judicial district in which Top Trends Hub may be found, and that they will accept service of process from the person who provided the original DMCA notice or an agent of that person.
    • The user’s physical or electronic signature.

Upon receiving a valid counter-notice, we will forward it to the original complaining party. If the original complaining party does not file a lawsuit within 10 business days, we may restore the removed content.

Repeat Infringers

Top Trends Hub reserves the right to terminate the accounts of users who are found to be repeat infringers.

Limitations of Liability

In accordance with the DMCA, Top Trends Hub assumes no liability for the removal of content in response to a valid DMCA notice, and we will not be liable for any claims resulting from the good faith removal of content in response to such a notice.
